ICSC President and CEO Tom McGee stopped by Bloomberg Markets to discuss the state of the retail industry one year after the landmark South Dakota v. Wayfair, Inc., Supreme Court ruling.
“It created parity between retailers that are on the physical and digital level, particularly small retailers,” McGee said. “A year later all but three states across the country have adopted legislation or regulation that’s fairly consistent with what the Supreme Court laid out in the South Dakota v. Wayfair decision. The three states that are still outstanding are Florida, Kansas and Missouri. And we would encourage them to pass similar legislation.”
McGee says any concerns that implementing the new system might cause chaos have proved unfounded. “There are a lot of protections in place for smaller retailers, to make sure that the implementation isn’t too onerous,” he said. “This was ICSC’s number-one legislative priority for decades. And we could never get it through the U.S. House, but the Supreme Court came down with a ruling in our favor.”
